Welcome to Scent of the Dunes (“SOTD”, “we”, “us”, “our”). We operate this website and store, including all related information, content, features, tools, products and services (the “Services”). Scent of the Dunes is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”) describe your rights and responsibilities when using the Services and incorporate our other policies by reference. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

Nothing in these Terms affects your legal rights under applicable consumer laws, including UK consumer protection regulations.

1. Access & Account

You must be at least 18 years old to use the Services. You agree to provide accurate, current information and to keep your account credentials secure. You are responsible for all activity under your account.

2. Our Products

We strive to represent products accurately, but colours and appearance may vary. Prices, availability, and descriptions may change without notice. Certain fragrance items may contain allergens and should be patch-tested prior to full use.

3. Orders

Your order constitutes an offer to purchase. We may accept or decline any order. By placing an order, you confirm it is for personal use and not for resale.

Orders are subject to our Shipping Policy and Return & Refund Policy, which form part of these Terms.

4. Prices & Billing

Prices may change without notice. Unless otherwise stated, prices exclude shipping costs, customs duties, import taxes, VAT, and any additional charges imposed by local authorities outside the United Kingdom.

By placing an order, you acknowledge and agree that any customs duties, import taxes, VAT, or related fees applicable to international shipments are the sole responsibility of the customer and must be paid directly to the relevant authority or courier.

You agree to provide accurate payment details and authorize charges for your order.

5. Shipping, Delivery & Risk of Loss

Dispatch timelines, handling periods, delivery estimates, courier updates, and regional shipping rules are governed by our Shipping Policy.

Risk of loss transfers to you once the parcel is handed to the courier.

For international orders, including shipments to the European Union and Iceland, the customer is solely responsible for any customs duties, import taxes, VAT, clearance fees, or other charges imposed by the destination country.

Scent of the Dunes has no control over customs processes and is not liable for delays, holds, additional charges, or refusals caused by customs authorities.

5B. Customs Refusals & Unpaid Charges

If a customer refuses to pay applicable customs duties, import taxes, VAT, or related fees, and the shipment is delayed, returned, or abandoned, Scent of the Dunes shall not be responsible for the outcome.

Shipping costs are non-refundable, and any additional costs incurred due to refusal or non-payment of customs charges may be deducted from any eligible refund, where applicable.

5A. Returns & Refunds

Returns are accepted within the UK only and must be requested within 14 days of delivery. Items must be unopened, unused, and in their original packaging to be eligible.

Customers are responsible for the return shipping cost.

No returns or refunds are available for international orders.

6. Intellectual Property

All content on our website is owned by Scent of the Dunes or its licensors and protected by applicable intellectual property laws.

7. Optional Tools

We may provide access to third-party tools “as is” and “as available”. Your use is subject to their terms.

We are not responsible for third-party websites or content.

9. Relationship with Shopify

Scent of the Dunes is powered by Shopify. However, all sales are made directly between you and Scent of the Dunes. Shopify is not responsible for any purchases, claims, damages, or liabilities arising from your transaction with us.

Your information is processed in accordance with our Privacy Policy and Shopify’s privacy practices. Shopify may store and process data in other countries as required to provide services.

11. Feedback & User Content

By submitting reviews or other content, you grant Scent of the Dunes a worldwide licence to use, publish and display the content for promotional and operational purposes.

12. Errors & Inaccuracies

We may correct errors, inaccuracies, or omissions at any time, including after an order has been placed.

13. Prohibited Uses

You may not use the Services for unlawful, harmful or abusive purposes, including sending malware, scraping content, or violating intellectual property rights.

We may suspend or terminate your access at any time. Sections that should survive termination will continue to apply.

These Terms constitute the entire agreement between you and Scent of the Dunes.

These Terms are governed by the laws of England and Wales. Disputes may be brought in UK courts.
